01 Acceptance of Terms
By accessing or using the XtremeDevelop website (xtremedevelop.com) and our software development services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our website or services. These Terms apply to all visitors, users, and clients of XtremeDevelop.
02 Description of Services
XtremeDevelop provides software development, IT consulting, web and mobile application development, UI/UX design, legacy system migration, and ongoing software support services. Specific deliverables, timelines, and pricing are defined in individual project agreements or statements of work (“SOW”) executed between XtremeDevelop and the client.
03 User Responsibilities
When using our website and services, you agree to:
- Provide accurate and complete information when submitting forms or requesting services
- Maintain the confidentiality of any account credentials or access information
- Use our services only for lawful purposes and in compliance with applicable laws
- Not attempt to gain unauthorized access to our systems, networks, or client data
- Not reproduce, duplicate, copy, or resell any part of our website without written permission
- Cooperate in good faith during project engagements, including timely provision of required materials and feedback
04 Intellectual Property
Unless otherwise specified in a signed SOW or project agreement:
- All content on this website — including text, graphics, logos, and software — is the property of XtremeDevelop and protected by intellectual property laws.
- XtremeDevelop retains ownership of pre-existing tools, frameworks, libraries, and methodologies used in project delivery.
- XtremeDevelop may showcase completed projects in its portfolio unless a confidentiality agreement states otherwise.
What you receive upon project completion depends on the delivery model agreed in your SOW. XtremeDevelop offers the following four engagement types:
1. Source Code & Full Deliverables
Upon full payment, the client receives ownership of custom source code, documentation, and related project assets created specifically for their project, as defined in the SOW. XtremeDevelop retains rights only to its pre-existing components and third-party libraries.
2. Compiled Product Access
The client receives a licensed right to use the finished product in compiled or deployable form only. Source code, build scripts, and internal architecture remain the property of XtremeDevelop unless explicitly transferred in the agreement.
3. Hosted Product Access
The client receives access to the product hosted on XtremeDevelop’s servers or managed hosting environment. The client does not receive source code or server ownership; access, uptime, and support terms are defined in the SOW.
4. SaaS-Based Product
The client receives subscription-based access to the software as a service. The platform, codebase, and infrastructure remain owned and operated by XtremeDevelop. Usage rights, user limits, and subscription terms are defined in the agreement.
The applicable delivery model, transfer of rights, and any licensing limitations will be clearly stated in your signed SOW before work begins.
05 Payment Terms
Payment terms are outlined in individual project agreements. General terms include:
- Invoices are due within the timeframe specified in the SOW (typically Net 15 or Net 30)
- Late payments may incur interest on outstanding balances only if and as specified in the applicable SOW or project agreement (for example, up to 1.5% per month where expressly agreed in writing)
- XtremeDevelop reserves the right to suspend work on overdue accounts
- All fees are quoted in INR (Indian Rupees) unless otherwise agreed in writing
- Refund policies, if applicable, are defined in the individual project agreement
06 Confidentiality
Both parties agree to maintain the confidentiality of proprietary information shared during the course of a business relationship. This includes trade secrets, business plans, technical specifications, source code, and client data. Confidentiality obligations survive termination of the business relationship for a period of three (3) years, unless a separate Non-Disclosure Agreement (NDA) specifies a different duration.
07 Limitation of Liability
To the maximum extent permitted by applicable law:
- XtremeDevelop shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our website or services.
- Our total liability for any claim arising from these Terms or our services shall not exceed the total amount paid by the client to XtremeDevelop in the twelve (12) months preceding the claim.
- We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components.
08 Termination
Either party may terminate a project engagement as specified in the applicable SOW. XtremeDevelop may suspend or terminate access to our website at any time for violation of these Terms. Upon termination, the client remains responsible for payment of all work completed up to the termination date. Provisions regarding confidentiality, intellectual property, and limitation of liability survive termination.
09 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Delhi, India.
10 Changes to Terms
XtremeDevelop reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a revised “Last updated” date. Continued use of our website or services after changes constitutes acceptance of the modified Terms.
